1. These terms and conditions apply to the $10,000 Deposit Promotion (“Promotion”) offered by 1150 Donnybrook Road Pty Ltd ACN 609 867 530 (“Vendor”).
  2. By participating in the Promotion, Eligible Purchasers agree to be bound by these terms and conditions. Eligible Purchasers must comply with these terms and conditions to participate in the Promotion.
  3. The Promotion applies to the following lots at Matilda, 1150 Donnybrook Road, Donnybrook:
    (a) lots 130, 133 to 135 (inclusive) and 146 on plan of subdivision PS908985P (Stage 1B); and
    (b) lots 228 and 248 on plan of subdivision PS908988H (Stage 2)
    (“Lots”), for which a Qualifying Contract is entered into with the Vendor.
  4. The Promotion commences at 9.00am on 16 September 2024 and ends at 5.00pm on 31 December 2024 (“Promotion Period”).
  5. The Promotion is only available for contracts of sale for Lots which are entered into during the Promotion Period (“Qualifying Contract”). If all Lots have been sold or allocated before the Promotion Period expires, the Promotion may cease at the Vendor’s absolute discretion.
  6. The Promotion is only available to Australian residents over the age of 18 years (“Eligible Purchasers”).
  7. If an Eligible Purchaser enters into a Qualifying Contract, the Eligible Purchaser will be required to only pay a deposit of $10,000 (“Reduced Deposit”).
  8. The Eligible Purchaser will be entitled to pay the Reduced Deposit provided that the Eligible Purchaser:
    (a) pays the Reduced Deposit on or before the date required under the Qualifying Contract;
    (b) complies with all of the terms of the Qualifying Contract; and
    (c) effects settlement of the Qualifying Contract on the due date.
  9. The Reduced Deposit must be paid by way of cash (not bank guarantee or deposit bond), in accordance with the terms of the Qualifying Contract. The Reduced Deposit is not a rebate or price reduction.
  10. The Promotion may only be applied once for each Qualifying Contract. Where a Qualifying Contract is entered by more than one person all of whom are Eligible Purchasers, then the Promotion is available jointly to all such persons.
  11. The Eligible Purchaser must disclose the contents of this Promotion to any lending institution providing finance to the Eligible Purchaser for the purchase of the Lot.
  12. The sale of a Lot will be subject to the conditions of the Qualifying Contract. To the extent of any inconsistency between these terms and conditions and the Qualifying Contract, terms of the Qualifying Contract prevails.
  13. The Vendor reserves the right to vary the terms of, or cancel, the Promotion at any time without notice.
  14. The Promotion is not available in conjunction with any other promotion or offer by the Vendor (other than to the extent that a promotion, incentive or benefit is referred to in the Qualifying Contract of Sale).
  15. To the full extent permissible by law, the Vendor (including the Vendor’s related entities, employees, contractors, agents and servants) is not liable to any Eligible Purchaser for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising out of or in connection with the Eligible Buyer’s participation in this Promotion.
